1. Agreement to these Terms

These Terms of Service ("Terms") are an agreement between you and FeastFolk LLC ("FeastFolk," "we," "us," or "our") governing your access to and use of the FeastFolk mobile application and related services (together, the "Platform").

By creating an account, tapping "Sign Up," "Create account," "Sign in," or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Platform.

We may update these Terms from time to time as described in Section 25. Continued use of the Platform after an update means you accept the revised Terms.

2. Who can use FeastFolk

You must be at least 18 years old and able to form a binding contract to create an account or use the Platform. By using FeastFolk, you represent that you meet these requirements and that all information you provide is accurate and current.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [security@feastfolk.com] if you suspect unauthorized use.

3. What FeastFolk is — and isn’t

FeastFolk operates a marketplace platform that connects independent home cooks ("Hosts") who prepare and offer food with people who discover and reserve it ("Guests"). FeastFolk is not a restaurant, caterer, food preparer, food seller, or employer of any Host.

Hosts are independent third parties, not FeastFolk employees, agents, or partners. FeastFolk does not prepare, handle, inspect, or take possession of any food offered on the Platform, and does not control the quality, safety, legality, or timeliness of any listing.

When you reserve a listing, you enter into a direct transaction with the Host for that listing. FeastFolk facilitates discovery, scheduling, messaging, and payment for that transaction but is not a party to it.

4. Accounts and sign-in

FeastFolk uses a third-party identity provider (Clerk) to authenticate accounts, including sign-in with an email or phone one-time code, Google, and Apple. You are subject to those providers’ own terms when you use them to sign in.

One account per person. You may not share your account, impersonate another person, or create an account for anyone other than yourself.

A Host account additionally requires the information necessary to receive payouts and to verify your identity. See Section 6 for Host-specific obligations.

5. The five kinds of listings

FeastFolk supports five listing formats, each with its own shape: a Scheduled Drop (a Host cooks a batch and Guests collect it within a pickup window), Catering (a tray or order for a group, quoted and booked by request), a Host’s Table (Guests sit down together at the Host’s home for one seating and one menu), a Private Chef booking (a Host cooks in the Guest’s own kitchen), and an Event (a larger gathering, such as a cookout or stall, hosted by one or more cooks).

Host’s Table and Private Chef listings may involve entering someone else’s private residence. FeastFolk does not conduct in-person kitchen inspections, criminal background checks, or home-safety inspections of Hosts or Guests unless we expressly state otherwise for a specific verification badge. A "Verified" badge or similar indicator reflects only the specific criteria we describe for it at the time — never a general guarantee of safety, identity, or conduct. You are responsible for exercising your own judgment, and you use any in-person meeting arrangement at your own risk.

6. Hosts: listing and selling food

As a Host, you are solely responsible for the food you offer, including its preparation, ingredients, storage, transport, and pickup handling, and for complying with all laws that apply to you — including food-handler permits, cottage food or home-kitchen operation laws, labeling requirements, and any local health department rules in the jurisdiction where you cook and sell. Laws governing home-based food sales vary significantly by state, county, and country, and it is your responsibility to know and follow the ones that apply to you, not FeastFolk’s.

You must list only food you are legally permitted to sell, describe it accurately, and disclose known ingredients and allergens to the best of your knowledge. Allergen and ingredient information you provide is shown to Guests as coming from you; FeastFolk does not independently verify it (see Section 8).

When you use the photo-scan feature to help draft a new listing, the description, ingredients, and allergen suggestions it produces are a starting proposal only. You must review, correct, and confirm every field before it is published — FeastFolk never publishes AI-generated listing content without your review (see Section 13).

You are an independent participant on the Platform, not a FeastFolk employee, contractor, joint venturer, or agent. You are responsible for your own tax obligations arising from amounts you earn through the Platform.

7. Guests: reserving and picking up food

When you reserve a listing, you agree to pay the listed price for the portions or booking you request and to collect your order during the stated pickup window (or attend the stated sitting/service), unless the listing is cancelled by the Host or by FeastFolk.

If you have a food allergy or dietary restriction, review the listing’s allergen and ingredient information and confirm directly with the Host before reserving or picking up — see Section 8.

A pickup pass (a QR code shown in-app) is issued once your reservation is confirmed and is used to verify collection. Treat your pass like a ticket: do not share it with anyone you have not authorized to collect on your behalf.

8. Allergens and food safety — please read this carefully

Ingredient, allergen, calorie, and nutritional information shown on a listing is provided by the Host, and, where an AI-assisted draft was used, was reviewed and confirmed by the Host before publishing. FeastFolk does not test, inspect, or independently verify this information, and does not guarantee that any listing is free of a particular allergen or ingredient, including through cross-contact during preparation.

If you have a food allergy, intolerance, or other dietary restriction, you must confirm directly with the Host before relying on any listing, and you assume the risk of any reaction if you choose to proceed. FeastFolk is not liable for illness, allergic reaction, or injury arising from food obtained through the Platform, to the fullest extent the law allows (see Section 20 and Section 21).

9. Fees, payments, and payouts

FeastFolk currently retains 12% of the gross amount a Guest pays for a listing, and pays the remaining 88% to the Host, to cover the cost of running verification, payments, and support. We may change this split prospectively for future transactions with reasonable notice.

Payments are processed by a third-party payment processor. FeastFolk does not store your full payment card number. By adding a payment method, you also agree to that processor’s own terms.

Prices are shown in whole US dollars. All sales are between the Guest and the Host; refund and cancellation terms for a specific reservation are described in Section 10.

10. Cancellations and no-shows

A Guest who cancels a reservation, and a Host who cancels a listing, are both subject to the cancellation window and refund terms shown at the time of booking for that listing. If a Host cancels a listing entirely, everyone already reserved on it is refunded.

If a Guest does not collect a confirmed order during its pickup window ("no-show"), the Host is still paid in full for that reservation — a no-show is treated as a failure to collect, not a failure to pay. A first no-show is recorded as a warning on the Guest’s account; a third no-show pauses the account from making new reservations until we review it.

We may adjust or reverse a no-show record where we determine, in our reasonable judgment, that the miss was caused by the Host (for example, the listing was not actually available for pickup as described).

11. Flavor Tokens, badges, and the Cultural Passport

Flavor Tokens are a promotional, engagement feature, not currency and not a store of value. Tokens are earned by exploring the Platform (trying new cuisines, completing quests, and similar activity), not purchased with money, and are never a discount on a Host’s work or a substitute for payment. Tokens have no cash value, cannot be sold, transferred, exchanged, or redeemed for cash, and may be adjusted, capped, or removed by FeastFolk at any time, including on account termination.

Badges and Cultural Passport stamps are recognitions of activity on the Platform. They confer no monetary value and no rights beyond what is described where they are shown in the app.

FeastFolk may change, limit, or discontinue Tokens, badges, quests, or any other gamification feature at any time without liability to you.

12. Reviews and other content you post

When you post a review, message, photo, or other content on the Platform, you must be truthful and you must have the right to post it. You may not post a review for a reservation that did not happen, offer or accept anything of value in exchange for a review, or post content that is false, defamatory, harassing, or that discloses someone else’s private information without consent.

You grant FeastFolk a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display content you submit, solely to operate and improve the Platform (for example, showing your review on a listing, or a dish photo you submit as part of a Host listing). You keep ownership of what you post.

We may remove or decline to display content that violates these Terms or that we determine, in our reasonable judgment, is harmful, fraudulent, or unlawful.

13. The AI photo-scan feature

Some Host flows let you photograph a dish and have it analyzed by a third-party AI service to propose a draft dish name, cuisine, ingredients, allergens, and description. This is always a proposal, never a publication — nothing produced this way is shown to Guests until the Host reviews and confirms it.

AI-generated suggestions can be inaccurate or incomplete, including for allergens. FeastFolk is not responsible for errors in AI-generated drafts; responsibility for what is ultimately published rests with the Host who confirmed it, per Section 6.

14. Messaging and notifications

Once a reservation is confirmed, FeastFolk opens an in-app message thread between the Guest and Host so they can coordinate pickup details. That thread closes automatically two hours after the pickup window ends, stays read-only for a further 24 hours, and is then permanently removed — plan to save anything you need before then.

By creating an account you consent to receive service-related push notifications and messages (for example, reservation confirmations, pickup reminders, and payout notices). You can manage optional notification categories in Settings, and you can disable push notifications for FeastFolk entirely in your device’s system settings at any time; some account and safety notices may still be delivered in-app regardless.

15. Location and contacts

FeastFolk uses your device’s location, where you grant permission, to show nearby listings and calculate distance. You can deny or revoke location permission at any time in your device settings; some discovery features will be limited without it.

If you choose to invite or gift tokens to someone from your device’s contacts, FeastFolk accesses your contacts only after you grant that permission and only to power that specific feature — see our Privacy Policy for exactly what is read and stored.

16. Prohibited conduct

You agree not to: violate any law applicable to your use of the Platform, including food-safety and licensing law; misrepresent a listing, your identity, or your qualifications; harass, threaten, or discriminate against another user; attempt to complete a transaction outside the Platform to avoid fees; scrape, reverse-engineer, or interfere with the Platform’s operation or security; upload content you don’t have rights to; or use the Platform for any purpose other than discovering, offering, or fulfilling home-cooked food listings.

We may suspend or terminate accounts that violate this section, in addition to any other remedy available to us.

17. Intellectual property

The Platform, including its design, text, graphics, logos, and software, is owned by FeastFolk or our licensors and is protected by intellectual property law. Except for the license you grant us in Section 12 and the limited right to use the Platform as intended, these Terms do not grant you any rights to our intellectual property.

18. Third-party services

The Platform relies on third-party services to operate, including Clerk (identity and sign-in), Google and Apple (social sign-in), a third-party AI service (dish photo analysis), a payment processor, and push-notification delivery services provided by Apple and Google. Your use of those integrations is also subject to each provider’s own terms and privacy practices, which we encourage you to review.

We are not responsible for the acts or omissions of these third parties, though we choose providers we believe handle your information responsibly.

19. Disclaimers

THE PLATFORM AND ANY LISTINGS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FEASTFOLK DOES NOT WARRANT THAT ANY LISTING IS SAFE, LAWFUL, ACCURATELY DESCRIBED, OR FREE OF ANY PARTICULAR ALLERGEN OR INGREDIENT.

FEASTFOLK IS NOT RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY HOST OR GUEST, INCLUDING AT ANY IN-PERSON PICKUP, SITTING, OR HOME VISIT.

20. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FEASTFOLK AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM OR ANY LISTING, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, FEASTFOLK’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO FEASTFOLK (NOT INCLUDING AMOUNTS PAID THROUGH TO A HOST) IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100.

Some jurisdictions do not allow certain limitations on liability, so some of the above may not apply to you.

21. Indemnification

You agree to defend, indemnify, and hold harmless FeastFolk from any claim, liability, damage, loss, and expense (including reasonable attorneys’ fees) arising from your listings, your content, your violation of these Terms, or your violation of any law or third-party right.

22. Dispute resolution and governing law

These Terms are governed by the laws of [State/Country of Incorporation], without regard to its conflict-of-law principles.

Before filing a claim, you agree to first contact us at [legal@feastfolk.com] so we can try to resolve the dispute informally. [Add binding arbitration / small-claims-court carve-out / class-action-waiver language here once counsel confirms which mechanism applies in your jurisdiction and user base.]

23. Termination

You may stop using the Platform and delete your account at any time in Settings. We may suspend or terminate your access if we reasonably believe you have violated these Terms, created risk or legal exposure for us or another user, or if required by law.

Sections that by their nature should survive termination (including Sections 8, 9–non-payment obligations, 12’s license grant, 17, 19, 20, 21, and 22) survive.

24. Changes to these Terms

We may modify these Terms from time to time. If we make a material change, we will provide reasonable notice, such as an in-app notice or an update to the "last updated" date below. Your continued use of the Platform after a change takes effect constitutes acceptance of the revised Terms.
